1. Acceptance of Terms
By engaging Nimbus Hartford Concrete for concrete services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the client) and Nimbus Hartford Concrete. If you do not agree to these terms, please do not engage our services.
2. Services Provided
Nimbus Hartford Concrete provides professional concrete contractor services including but not limited to driveway installation and repair, patios, walkways, sidewalks, foundations, slabs, footings, retaining walls, concrete repair, resurfacing, leveling, stamped and decorative concrete, concrete cutting, removal, replacement, parking lots, curbs, and commercial flatwork. All services are provided in accordance with industry standards and local building codes.
3. Quotes and Estimates
All quotes and estimates provided by Nimbus Hartford Concrete are valid for 30 days from the date of issue unless otherwise specified. Quotes are based on the information provided by the client and site conditions visible at the time of assessment. Additional charges may apply if unforeseen conditions are discovered during project execution, such as poor soil conditions, hidden utilities, or other complications. We will notify clients of any additional costs before proceeding with work that exceeds the original quote.
4. Payment Terms
Payment terms will be specified in the project contract. Typically, a deposit is required before work begins, with the balance due upon project completion. We accept various payment methods including cash, check, and credit cards. Late payments may be subject to interest charges as permitted by law. Nimbus Hartford Concrete reserves the right to place a mechanic's lien on the property for unpaid balances.
5. Project Timeline
Project timelines are estimates based on normal working conditions and weather. Nimbus Hartford Concrete will make reasonable efforts to complete projects within the estimated timeframe. However, delays may occur due to weather conditions, material availability, permit delays, or other factors beyond our control. We are not liable for damages resulting from project delays caused by circumstances outside our reasonable control.
6. Client Responsibilities
Clients are responsible for providing accurate information about the project site, obtaining necessary permissions from property owners or homeowner associations, ensuring access to the work area, and marking or identifying underground utilities before work begins. Clients must also remove or protect personal property in the work area. Failure to fulfill these responsibilities may result in project delays or additional charges.
7. Warranties
Nimbus Hartford Concrete warrants that all work will be performed in a professional manner using quality materials. Specific warranty terms vary by project type and will be detailed in the project contract. Warranties do not cover damage caused by improper use, lack of maintenance, ground movement, freeze-thaw cycles beyond normal expectations, or other factors outside our control. Warranty claims must be submitted in writing within the warranty period.
8. Limitation of Liability
Nimbus Hartford Concrete's liability is limited to the contract price of the services provided. We are not liable for indirect, incidental, consequential, or punitive damages. Our liability does not extend to damage caused by acts of nature, ground movement, hidden site conditions, or other factors beyond our reasonable control. Clients are encouraged to maintain appropriate property insurance.
9. Changes and Cancellations
Changes to the project scope must be requested in writing and may result in additional charges and timeline adjustments. Project cancellations must be submitted in writing. Cancellation fees may apply based on work already performed, materials ordered, and scheduling commitments made. Deposits are non-refundable once work has commenced or materials have been ordered.
10. Dispute Resolution
Any disputes arising from these terms or services provided shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Hartford County, Connecticut. The prevailing party shall be entitled to recover reasonable attorney fees and costs.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any legal action arising from these terms must be brought in the courts of Hartford County, Connecticut.
12. Modifications to Terms
Nimbus Hartford Concrete reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with a new effective date. Continued use of our services after changes constitutes acceptance of the modified terms. For existing contracts, the terms in effect at the time of contract signing shall apply.
